Robb Leandro is a Partner in the Raleigh, NC office of Parker Poe Adams & Bernstein LLP. Robb assists his clients with a broad range of legal issues relating to health care, administrative law and public policy. His legal practice focuses on helping health care providers navigate the minefield of regulations that they face in their practices.

Robb routinely assists clients with Medicaid and Medicare regulations and audits; Certificate of Need Applications and litigation; licensure, surveys, and certification issues; and HIPAA and privacy laws. Robb also provides counsel to health care providers with complex government contract procurement issues.

Robb’s clients range from large national health care providers to small single-location providers. He has significant experience representing a variety of health care providers that include nursing homes, home health, home care and hospice agencies, hospitals, community mental health providers, adult care homes, psychiatric hospitals, physician practices, and dentists. He also has significant experience providing advice to health care industry groups and trade associations.

By focusing on regulatory compliance issues before there is a problem, Robb strives to have his clients avoid missteps and government investigations. When litigation is required, Robb draws on years of relevant health care and administrative law experience to advocate for his clients. He has successfully represented health care providers before the North Carolina Office of Administrative Hearings (OAH) in cases including Medicaid audits, licensure terminations, Managed Care Organization (MCOs) actions and Certificate of Need (CON) decisions.

Robb is a leader in the state’s health care legal community. He served as president of the North Carolina Society of Health Care Attorneys from 2018 to 2019 and continues to serve on its board of directors.

  • Represented a large home care provider in a two-week administrative law hearing, which resulted in a decision reversing a $4.5 million recoupment.
  • Obtained a decision from the North Carolina Office of Administrative Hearings reversing a decision to revoke a mental health facility license.
  • Assisted in several successful Certificate of Need administrative hearings.
  • Prevailed in an administrative hearing relating to a significant Medicaid recoupment and successfully defended an appeal of the decision by the North Carolina Division of Medical Assistance.
  • Assisted in litigation that successfully challenged home care regulatory changes. The court’s decision allowed thousands of disabled and elderly North Carolinians to continue to receive home care services.
  • Prevailed in a federal court challenge of federal hospice regulation.
  • Successfully appealed Medicare decisions to recoup funds from hospice providers.
  • Argued in Superior Court a case involving a successful constitutional challenge to legislation that limited municipal annexation authority.
  • Obtained numerous favorable settlements involving Medicaid audits and licensure violations, including several recoupments of more than $1 million that were settled for less than 1 percent of the government’s original recoupment request.
