Jeff Marcus, an experienced trial lawyer, focuses his practice on high-stakes healthcare, white collar cases, regulatory enforcement, and complex civil litigation matters. He represents plaintiffs and defendants in high-stakes civil litigation and, in recent years, has recovered more than $25 million on behalf of his clients.
For the last several years, he has been ranked in the top band for litigation by the prestigious publication Chambers USA. In those merit rankings, peers and clients said Jeff is “top of the field in the U.S. when it comes to healthcare fraud matters with significant experience in matters concerning the False Claims Act.” He also was described as being “extremely smart, extremely analytical in how he approaches things and well rounded” and “incredibly smart; known to be a great writer, a great arguer and a very good trial lawyer.”
Jeff represents clients across industries including healthcare, pharmaceuticals, cryptocurrency, energy, financial services, government contracts, insurance and reinsurance, media and entertainment, professional sports, real estate, securities, and technology. He defends corporations and individuals in investigations and enforcement matters brought by federal and state agencies, including matters involving alleged violations of federal healthcare and pharmaceutical laws, federal securities and commodities laws, the Foreign Corrupt Practices Act, and money laundering offenses.
Jeff has been retained and testified as a subject matter expert in fraud and securities matters, including being designated as an expert witness in securities fraud litigation in the Northern District of Texas on behalf of the court-appointed receiver overseeing the former Stanford Financial Group which ran one of the largest Ponzi schemes in U.S. history. He maintains an active pro-bono practice and served for 8 years as a member of the Criminal Justice Act (“CJA”) Panel in the Southern District of Florida representing indigent federal criminal defendants.
Prior to MNR, Jeff headed the white-collar practice group of a leading South Florida firm. Before that, he served as a federal prosecutor in South Florida who specialized in white-collar crime. As an Assistant United States Attorney Jeff successfully tried more than 25 cases to verdict and briefed and argued numerous appeals. Based on his prosecutorial experience, Jeff has been asked to lead a number of internal investigations for public and privately-held corporations for boards of directors, audit committees, and special board committees.
After law school, Jeff clerked for the Honorable Stanley Marcus of the U.S. Court of Appeals for the Eleventh Circuit (no relation) and the Honorable Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida. He has taught constitutional criminal procedure and legal writing and advocacy at the University of Miami and speaks nationally on litigation and white-collar topics.
In this era of heightened government enforcement, perhaps no industry is as closely regulated and scrutinized as healthcare. Between changing rules and regulations, whistleblowers lawsuits under the False Claims Act and industry-wide investigations led by federal prosecutors, no company in the healthcare, medical device or pharmaceutical industry is safe from risk. Your involvement in a wide range of investigations, enforcement actions and audits potentially can lead to catastrophic criminal, civil and administrative penalties and incarceration for individual executives and employees.
Utilizing our experience as former federal prosecutors with subject matter expertise in healthcare fraud and qui tam investigations, we regularly defend clients in criminal and civil matters in federal and state jurisdictions throughout the country. We represent corporations of all sizes as well as individual executives and employees. Our cases often involve allegations related to:
- Offering or receiving kickbacks and other financial inducements;
- Creating or maintaining improper financial relationships in violation of the Stark Act;
- Billing improprieties for services not rendered, not medically indicated or necessary, upcoding and double billing;
- Filing of false claims with government health programs;
- Provision of inadequate or substandard medical care;
- Provision of experimental or cutting-edge medical treatments not in line with relevant standards of medical care;
- Improper sales and marketing of drugs, medical devices, and durable medical equipment; and
- Improper branding, labeling and dispensation of pharmaceuticals, devices and other products regulated by the Food, Drug, and Cosmetic Act;
- HIPAA compliance.
We also are experienced in serving as “pool counsel” for the employees of corporations. Frequently, we are asked to conduct internal investigations on behalf of corporations, boards of directors or audit committees regarding regulatory compliance.
Our trial experience becomes your advantage at all stages of civil litigation, criminal litigation and government investigations, and serves as the ultimate leverage in cases approaching trial. We relish the tough fights, with the bulk of our practice focusing on high stakes or “bet the company” cases, whether in South Florida or elsewhere in the United States.
We represent individuals and businesses of all sizes, from Fortune 100 to family-owned companies, and prioritize our clients by handling only a small number of cases at any given time.
